Please read these Terms of Service ("Terms") carefully before using Fivecourse Catering's services. These Terms govern your use of our website, mobile applications, and catering services. By accessing or using our services, you agree to be bound by these Terms.

1. Services

Fivecourse Catering provides professional catering services including but not limited to wedding catering, corporate event catering, private dinner services, and related culinary services. All services are provided subject to availability and our acceptance of your booking request.

2. Booking and Reservations

  • Booking Confirmation: All bookings are confirmed only upon our written acceptance and receipt of the required deposit.
  • Event Details: You must provide accurate and complete information about your event, including date, time, location, guest count, and any special requirements.
  • Changes: Any changes to your booking must be communicated in writing and are subject to our approval and additional charges if applicable.

3. Pricing and Payment

  • Estimates: All quotes and estimates are subject to change until a written agreement is signed.
  • Deposit: A 50% deposit is required to secure your booking. The deposit is non-refundable.
  • Final Payment: The remaining balance is due 7 days before your event date.
  • Additional Charges: Any additional services, changes, or charges will be billed separately and are due immediately.
  • Payment Methods: We accept major credit cards, checks, and electronic payments. All payments are processed securely through third-party processors.

4. Cancellation Policy

  • 30+ Days: Cancellations made 30 or more days before the event receive a full refund of the balance (deposit is non-refundable).
  • 15-29 Days: Cancellations made 15-29 days before the event are subject to a 25% charge of the total contract value.
  • 8-14 Days: Cancellations made 8-14 days before the event are subject to a 50% charge of the total contract value.
  • 7 Days or Less: Cancellations made 7 days or less before the event are subject to a 100% charge of the total contract value.
  • Force Majeure: We reserve the right to cancel or reschedule events due to circumstances beyond our control (e.g., severe weather, natural disasters, government restrictions).

5. Client Responsibilities

  • Venue Access: You must ensure we have adequate access to the venue for setup, service, and cleanup.
  • Equipment: You are responsible for providing adequate refrigeration, heating, and serving areas as specified in our agreement.
  • Electrical: You must provide adequate electrical outlets and power sources for our equipment.
  • Safety: You must ensure the venue meets all safety and health code requirements.
  • Alcohol: If serving alcohol, you must comply with all applicable laws and provide proper supervision.

6. Dietary Restrictions and Allergies

While we make every effort to accommodate dietary restrictions and allergies, you must inform us of any food allergies or dietary restrictions in writing. We cannot ensure a completely allergen-free environment. You assume all responsibility for monitoring your own dietary intake and that of your guests.

7. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, utility failures, or government actions.

8. Liability and Insurance

  • General Liability: Our maximum liability for any claim arising out of our services shall not exceed the total amount paid by you for the specific event giving rise to the claim.
  • Property Damage: We are not responsible for any damage to venues, equipment, or personal property unless caused by our direct negligence.
  • Alcohol Service: You assume full responsibility for the actions of guests consuming alcohol at your event.
  • Health Code: We maintain all necessary documentation and permits and follow all applicable health codes and regulations.

9. Intellectual Property

All content on our website, including text, images, logos, and designs, are our property or the property of our licensors. You may not use any of our intellectual property without our prior written permission.

10. Privacy

11. Indemnification

You agree to indemnify and hold harmless Fivecourse Catering, its owners, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your event, your breach of these Terms, or your violation of any applicable laws or regulations.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles. Any legal action arising out of or relating to these Terms shall be brought in the courts of Wisconsin.

13. Modifications

We reserve the right to modify these Terms at any time. Any changes will be posted on our website with an updated effective date. Your continued use of our services after such changes constitutes your acceptance of the modified Terms.

14. Entire Agreement

These Terms, along with our written agreement for your specific event, constitute the entire agreement between you and Fivecourse Catering regarding the subject matter hereof and supersede all prior agreements and understandings, whether written or oral.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

By booking our services or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services. We recommend that you keep a copy of these Terms for your records.
